Проблемы реализации отдельных полномочий лицензионно-разрешительных подраздений Росгвардии

Abstract

Цель исследования – анализ реализации полномочий лицензионноразрешительных подразделений Росгвардии по осуществлению федерального государственного контроля (надзора) за соблюдением законодательства в области оборота оружия. В статье акцентируется внимание на необходимости снижения нарушений в области оборота оружия как средстве повышения эффективности мер противодействия совершению преступлений с использованием оружия и в области оборота оружия. Проанализированы объем полномочий подразделений лицензионно-разрешительной работы Росгвардии по предупреждению и пресечению правонарушений в области оборота оружия и проблемы, связанные с отсутствием единообразного толкования и применения судами диспозиций КоАП РФ, предусматривающих административную ответственность за правонарушения в области оборота оружия. Приведена соответствующая судебная практика. Обоснована необходимость конкретизации и предложена новая редакция ч. 4 ст. 20.8 КоАП РФ для повышения эффективности мер противодействия нарушениям в области оборота оружия, соблюдения конституционных принципов юридического равенства и справедливости в отношении владельцев оружия, допустивших его хранение с истекшим сроком действия разрешений. The purpose of the study is to analyze the implementation of the powers of the licensing and permitting units of Rosgvardia to carry out federal state control (supervision) over compliance with the legislation in the field of arms trafficking. The article emphasizes the need to reduce violations in the field of arms trafficking as a means of improving the effectiveness of measures to counter the commission of crimes involving the use of arms and in the field of arms trafficking. The scope of powers of units of licensing and permitting work of Rosgvardia, to prevent and suppress offences in the field of arms trafficking and problems related to the lack of uniform interpretation and application by courts of dispositions of the Administrative Code of the Russian Federation, providing for administrative liability for offences in the field of arms trafficking, were analyzed. Relevant jurisprudence is provided. The need to specify and propose a new version of Part 4 of Article 20.8 of the Administrative Code of the Russian Federation, in the achievement of the goals of improving the effectiveness of measures to counter violations in the field of arms trafficking, compliance with the constitutional principles of legal equality and justice with regard to the owners of weapons that have allowed their storage with expired permits.
