Решения Конституционного Суда РФ как средства правового регулирования общественных отношений

Abstract

В статье исследуются взгляды сторонников и противников признания за решениями судов и Конституционного Суда РФ, в частности, свойства правового регулирования общественных отношений. Предлагаются критерии рассмотрения юридических свойств решений Суда, которые, по мнению авторов, позволяют рассматривать данные решения как средства правового регулирования, источники отрасли конституционного права. В целях аргументации признания за решениями судов свойств правового регулирования общественных отношений анализируются поставления Пленума Верховного Суда РФ и Конституционного Суда РФ на наличие признаков свойств правового регулирования общественных отношений. В заключение делаются выводы о том, что именно решения Конституционного Суда РФ могут иметь свойства правового регулирования общественных отношений. The article examines the views of supporters and opponents of the recognition of the decisions of the courts and the Constitutional Court of the Russian Federation in particular, the properties of the legal regulation of social relations. The criteria for reviewing the legal properties of the decisions of the Court, which, according to the authors, make it possible to consider these decisions as means of legal regulation, sources of the branch of constitutional law, are proposed. In order to argue the recognition of the decisions of the courts on the properties of the legal regulation of public relations, the Plenum of the Supreme Court of the Russian Federation and the Constitutional Court of the Russian Federation on the issue of the presence of signs of the properties of the legal regulation of public relations are analyzed. In conclusion, it is stated that it is the decisions of the Constitutional Court of the Russian Federation that can have the properties of the legal regulation of public relations.
