dc.description.abstract | Вхождение в состав Российской Федерации Крымского полуострова вместе с самостоятельным субъектом - г. Севастополем обозначило начало процесса фактического и правового реформирования земельных отношений на соответствующей территории. Проблемных точек в данном аспекте множество, наиболее существенными являются отсутствие генерального плана развития города и неоднородная судебная практика по одним и тем же фактическим обстоятельствам дела, но в отношении участков, расположенных в различных местах. Сложность в содержании рассматриваемого вопроса также заключается в том, что люди живут или иным образом используют свои земельные участки на протяжении весьма продолжительного периода времени. Сменяются государственные режимы, но граждане воспринимают свое недвижимое имущество полностью неотчуждаемым. С приходом новой власти приходит совершенно иное нормативное правовое регулирование, и данная парадигма меняется, к сожалению, далеко не всегда в лучшую сторону. Еще один аспект, усложняющий решение указанных проблем, заключается в том, что формально г. Севастополь на половину в территориальном аспекте городом не является, включая в себя леса, горы, заповедники и т.д. Тем не менее федеральными органами исполнительной власти указанный город продолжает восприниматься как один большой населенный пункт. Помимо того, что подобный разбор с доктринальной точки зрения полезен самому Севастополю, авторский коллектив пришел к выводу о необходимости трансформации федерального законодательства. Сложности, с которыми сталкиваются новые территории, дают положительный опыт для всего государства в целом. The entry into the Russian Federation of the Crimean Peninsula together with an independent entity - the city of Sevastopol marked the beginning of the process of actual and legal reform of land relations in the relevant territory. There are a lot of problem points in this aspect, the most significant are the lack of a master plan for the development of the city and heterogeneous judicial practice for the same factual circumstances of the case, but with respect to plots located in different places. The difficulty in the content of the issue under consideration also lies in the fact that people live or otherwise use their land for a very long period of time. State regimes are changing, but citizens perceive their real estate as completely inalienable. With the adve nt of the new government, completely different regulatory legal regulation comes, and this paradigm is changing, unfortunately, not always for the better. Another aspect complicating the solution of these problems is that formally, the city of Sevastopol is not completely a city the territorial aspect, including forests, mountains, reserves, etc. Nevertheless, the federal executive authorities said the city continues to be perceived as one large settlement. In addition to the fact that a similar analysis from a doctrinal point of view is useful to Sevastopol itself, the team of authors came to the conclusion that it is necessary to transform federal legislation. The difficulties faced by the new territories provide a positive experience for the entire state as a whole. | ru_RU |
