Реализация конституционного права на благоприятную окружающую среду в трудовых отношениях

Abstract

Конституционное право на защиту окружающей среды имеет межотраслевой характер. В трудовом законодательстве уделяется не достаточно много внимания экологическим вопросам. В этой связи требуется изменение подхода к экологическим проблемам в процессе трудовой деятельности и в рамках социального партнерства между работниками, работодателями и государством. Поддерживается мнение о необходимости регулирования отношений в сфере труда, связанных с окружающей средой, в рамках института социального партнерства. Правовое регулирование отношений между работником и работодателем в области сохранности окружающей среды должно осуществляться в двух направлениях. Во-первых, с целью обеспечения работодателем требований охраны труда в части соблюдения экологических предписаний. Во-вторых, с позиции выполнения работником правил внутреннего трудового распорядка, также касающихся требований экологической безопасности. Сделан вывод о необходимости внесения дополнений в ст. 21 и 22 Трудового кодекса РФ в части закрепления обязанностей работника и работодателя в области сохранности окружающей среды на рабочем месте и в процессе труда. The constitutional right to environmental protection has an intersectoral character. The labor legislation does not pay enough attention to environmental issues. In this re-gard, a change in the approach to environmental problems in the process of labor activity and in the framework of social partnership between workers, employers and the state is required. The opinion that it is necessary to regulate relations in the world of work related to the environment within the framework of the institution of social partnership is sup-ported. Legal regulation of relations between the employee and the employer in the field of environmental protection should be carried out in two directions. Firstly, in order to provide the employer with labor protection requirements in terms of compliance with environmental regulations. Secondly, from the point of view of the employee fulfilling the internal labor regulations, which also relate to environmental safety requirements. It is concluded that it is necessary to amend Art. 21 and 22 of the Labor Code of the Rus-sian Federation in terms of securing the duties of the employee and the employer in the field of environmental protection at the workplace and in the labor process.
