Категория «правомерное» во взаимосвязи с конституционными идеями и доктринами

Abstract

В статье рассматривается взаимосвязь категории «правомерное» с конституционными идеями, концепциями и доктринами. Обращение к основным концептам, регулирующим политику, правовую жизнь и культуру народа, позволяет проследить, как формируются и образуются основы, производящие право, и каким образом они формализуются в нормативные правила поведения. Обосновывается зависимость содержательной стороны правомерности от исторических условий ее интерпретации и государственных интересов, которые концепт правомерности призван обслуживать. По мнению автора, доктрина взаимодействия государства и человека (личности) может рассматриваться в качестве процесса и результата правомерного поведения основополагающих субъектов конституционных отношений. Связь правомерного поведения и конституционных идей (доктрин) проявляется в том, что социальные субъекты (индивиды и общности) признают и отстаивают собственную, отличную от других, систему ценностей, а правила и образцы поведения, которыми они руководствуются, отражают желаемую и признаваемую для них модель устройства властных отношений. The article examines the relationship of the category “legitimate” with constitu-tional ideas, concepts and doctrines. The appeal to the basic concepts that regulate the politics, legal life and culture of the people allows tracing how the foundations that pro-duce law are formed and organized, and how they are formalized into normative rules of behavior. The article substantiates the dependence of the content side of lawfulness on the historical conditions of its interpretation and state interests, which the concept of lawfulness is intended to serve. According to the author, the doctrine of interaction be-tween the state and the person (personality) can be considered as a process and result of the legitimate behavior of the fundamental subjects of constitutional relations. The con-nection between lawful behavior and constitutional ideas (doctrines) is manifested in the fact that social subjects (individuals and communities) recognize and defend their own, different from others, a system of values, and the rules and patterns of behavior by which they are guided reflect the desired and the model of the structure of power rela-tions recognized for them.
