Органы управления в области охраны окружающей среды в Российской Федерации: вопросы формирования полномочий

Abstract

Исследована современная система органов государственной власти, осуществляющих управление в сфере охраны окружающей среды в Российской Федерации. В статье рассматриваются дискуссионные вопросы, связанные с определением понятия «управление в области охраны окружающей среды», соотношением понятий «охрана окружающей среды» и «природопользование». Автором на основании сравнительного анализа полномочий различных органов государственной власти в области охраны окружающей среды определены круг органов, осуществляющих государственное управление в данной сфере и их компетенция. С учетом отнесения вопросов охраны окружающей среды и природопользования к совместному ведению Российской Федерации и ее субъектов, в статье рассмотрены механизмы распределения и передачи полномочий в данной сфере между органами государственной власти РФ и субъектов РФ. The modern system of government bodies in charge of environmental protection in the Russian Federation has been investigated. The article discusses controversial issues related to the definition of the concept of "management in the field of environmental protection", the relationship between the concepts of "environmental protection" and "nature management". The author, on the basis of a comparative analysis of the powers of various state authorities in the field of environmental protection, determines the range of bodies exercising state administration in this area and their competence. Taking into account the attribution of environmental protection and nature management issues to the joint jurisdiction of the Russian Federation and its constituent entities, the article examines the mechanisms for the distribution and transfer of powers in this area between the state authorities of the Russian Federation and the constituent entities of the Russian Federation.
